Agreement to Terms of Use
By accessing this Birchcliff Bluffs United Church (“BBUC”) website, you are agreeing to be bound by these website Terms of Use, and all applicable laws and regulations. You are also agreeing that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the BBUC website. The materials contained in the BBUC website are protected by applicable copyright and trademark law.
These website Terms of Use also apply to your use or accessing of any other social media channels affiliated with BBUC and its programs, including Toby’s Place and Dorothy’s Place. The term “BBUC website” includes such social media channels to the extent applicable.

2. Use Licence
Permission is granted to temporarily download one copy of the materials (information or software) on the BBUC website for personal, non-commercial transitory viewing only.This is the grant of a licence, not a transfer of title, and under this licence you may not, unless we have given you our consent in writing:

use the materials for any commercial purpose or for any commercial or non-commercial public display;

attempt to decompile or reverse any software contained on the BBUC website;

remove or alter any copyright or other proprietary notations from materials contained on the BBUC website; or

This licence shall automatically terminate if you violate any of these restrictions and may be terminated by BBUC at any time. Upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Posting of Content
You are solely responsible for any content you post to a BBUC social media channel. BBUC reserves the right to delete, remove, or not accept any content you submit that BBUC believes, in its sole and unfettered discretion, is objectionable in any way including, without limitation, content that (i) may be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, hateful or discriminatory, (ii) may be false or misleading, (iii) may infringe another person’s intellectual property rights, (iv) is unrelated to the channel’s content, or (v) is commercial promotion or spam.
The materials on the BBUC website, including any of its social media channels, are provided “as is”. Use of or browsing of them is done at user’s risk. BBUC makes no warranties, expressed or implied and, to the extent permitted by law, hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose or non-infringement of intellectual property or other violation of rights. Further, BBUC does not warrant or make any representations concerning the accuracy, likely results or reliability of the use of the materials on the BBUC website or on any sites linked to the BBUC website.
In no event shall BBUC or its suppliers, contractors or any of its officers, employees, volunteers or other representatives, be liable for any damages whatsoever, including without limitation damages for loss of profit or data, consequential, incidental, punitive, aggravated or any other damages, caused or arising, directly or indirectly, out of your access to, use of, browsing and/or uploading or downloading content to or from the BBUC website (which term includes BBUC’s social media channels), or from other sites accessed through links on the BBUC website, including, without limitation, damages caused by or arising in any way from: (i) viruses or other malware that may damage your computer equipment or other property, (ii) your use of materials on the BBUC website or any sites or social media channels linked to or accessed through the BBUC website, (iii) service interruption or failure, your inability for any other reason to access or use materials on the BBUC website or to access or use a site linked to the BBUC website, or (iv) from any other cause whatsoever, even if BBUC or an authorized representative of BBUC has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for certain types of damages, some of these limitations may not apply in some circumstances.
You agree to indemnify and hold BBUC and its officers, employees, volunteers and other representatives harmless, for any and all loss or damage, including reasonable legal fees and expenses, arising from a claim or demand by any third party due to or arising out of your violation of these Terms of Use or your violation of any rights of another person through your use of the BBUC Website.
4. Revisions and Errors
The materials appearing on the BBUC website could include technical, typographical or photographic errors.BBUC does not warrant that any of the materials on the BBUC website are accurate, complete or current.BBUC may make changes to the materials on the BBUC website at any time without notice but does not make any commitment to update the materials.
BBUC has not reviewed all of the sites linked to the BBUC website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by BBUC of the site. Use of any such linked site is at the user’s own risk and is subject to that site’s terms of use.

BBUC may revise these Terms of Use for the BBUC website at any time without notice.By using the BBUC website you are agreeing to be bound by the then current version of these Terms of Use.

6. Governing Law
Any claim relating to BBUC’s website shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that Province, without regard to its conflict of law provisions.
